Service Subscription Terms
Welcome to Agentur Tschudin GmbH
By subscribing to one of our social media service packages, you agree to the following terms and conditions. Please read them carefully before proceeding with any of our services. These terms outline the guidelines for the use of services provided by Agentur Tschudin GmbH, which are productized into various social media packages.
1. Service Packages and Pricing
We offer three packages for social media services:
Standard Package: CHF 1,495/month
Growth Package: CHF 2,495/month
Pro Package: CHF 5,995/month
Each package provides a specific set of services, as outlined on our website. The services included in your chosen package are detailed in the package description and are subject to these terms.
All pricing is subject to change. In case of any changes, existing clients will be notified in advance, and updated pricing will apply from the next billing cycle.
2. Minimum Subscription Period
A minimum subscription period of three (3) months applies to all service packages. This minimum term is required to allow sufficient time for your social media strategy to deliver results.
After the initial 3-month period, the subscription continues on a rolling monthly basis unless terminated with 30 days' written notice.
3. Payment Terms
Payments are to be made monthly, in advance, for the upcoming month of service. You will receive an invoice for the total monthly fee based on your selected package.
All payments are due within 7 days of receiving the invoice.
Late payments may result in service suspension until payment is received.
4. Cancellation Policy
Cancellation of your subscription is only permitted after the initial 3-month commitment.
To cancel, you must provide 30 days' notice in writing. Cancellation requests must be sent to mail@tsch.agency. After the notice period, your subscription will be terminated, and no further payments will be charged.
5. Content Creation and Deliverables
Our packages include content creation services such as social media posts, stories, video editing, copywriting, and more. These services are outlined in your chosen package.
Any on-site photo or video production is not included in the package price and will be invoiced separately if required. We will provide scripts, mood boards, and recommendations for outsourcing these services to professional photographers/videographers if needed.
6. Onboarding Process
Upon selecting a package and signing up, you will be required to complete an onboarding questionnaire. This form will collect essential information such as branding guidelines, visual assets (images, videos), and details about your business objectives.
Passwords to Social Media Accounts: As part of our service, you will need to provide login credentials for your social media accounts. We guarantee that these credentials will be securely stored and used exclusively for the purpose of managing your social media platforms. We will never share your login details with any third parties.
Failure to provide all required assets, including social media passwords, in a timely manner may delay the start of services.
7. Influencer Marketing and Paid Advertising
Influencer Marketing: For the Growth and Pro packages, we will manage influencers on your behalf, but please note that the fees charged by influencers are paid separately and are not included in our package pricing.
Paid Ads: Any money spent on media buying (e.g., Facebook, Instagram ads) is covered by the client. The package includes media buying services such as ad setup, optimization, and management, but the ad budget itself is not included.
8. Reporting and Analytics
Standard Package: Includes a basic monthly performance report highlighting key metrics such as engagement, reach, and post performance.
Growth & Pro Packages: Include a detailed report with performance insights and actionable recommendations for further optimization. Pro package clients will also receive advanced analytics.
Reports are delivered monthly within five (5) business days of the end of each month.
9. Community Management
We offer community management services in each package, ranging from 15 minutes to 1 hour per day, depending on your selected package. Community management includes responding to comments, messages, and general audience engagement.
10. Upgrading Your Package
You may upgrade your service package at any time. To request an upgrade, please contact mail@tsch.agency. Any price adjustments will take effect from the next billing cycle.
11. Communication and Response Time
Our team will respond to all client communications and inquiries within 48 hours during normal business days.
12. Contract Agreement
Upon selecting a package and agreeing to move forward, a formal contract will be sent for your review and signature. This contract will outline all agreed-upon services, pricing, and additional terms and conditions.
No work will commence until the contract is signed and the first payment is received.
13. Limitation of Liability
Agentur Tschudin GmbH will not be held liable for any indirect, special, or consequential damages arising out of or in connection with the use of our services. Our maximum liability under this agreement is limited to the amount of fees paid by the client for the services provided.
14. Termination
We reserve the right to terminate services immediately if any of these terms are breached, or in case of non-payment.
15. Intellectual Property
Any content created by Agentur Tschudin GmbH as part of your package (such as posts, videos, and copywriting) remains your property once full payment has been received.
16. Governing Law
These terms and conditions are governed by the laws of Switzerland. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts in Zurich, Switzerland.
17. Consent and Data Privacy
Personal Data Collection: By filling out the form on our website, you consent to the collection and use of your personal data, which includes your first name, last name, email address, phone number, and the desired package. This information is necessary for us to provide our services and to contact you regarding your inquiry or package.
Use of Personal Data: The personal data you provide will be used solely for the purposes of delivering our services, including:
Contacting you to schedule a discovery call.
Sending you relevant information about our services.
Processing your chosen package and creating your account.
Data Security: We take data privacy seriously and ensure that your personal data is stored securely. Your information will never be shared with third parties, except as required by law, or to provide the services outlined (e.g., sharing data with subcontractors, if necessary, to deliver the services).
Data Retention: Your personal data will be retained only as long as necessary to fulfill the purposes outlined above, or as required by law.
